Here are two widely held positions on the ethics of dating: First, people are generally morally justified in excluding people they don’t find attractive from their dating pool. Second, people are not justified in maintaining a dating pool that is racially exclusive, even on grounds like attraction. In this paper, we demonstrate how these positions are consistent. To do so we differentiate our attitudes in dating and our dating behavior. Then we show how existing criticisms of racialized attitudes in dating (...) are incomplete as practical criticisms of our behavior. Finally, we give our account of the moral reasons whites have to change their dating preferences when they exclude people of color. In doing so, we supplement existing discussions of race-based discrimination in dating. (shrink)

Land is becoming increasingly scarce relative to the demands of the global economy; a problem significantly exacerbated by climate change. In response, some have suggested that land should be conceptualised as a global commons. This framing might seem like an appealing way to promote sustainable and equitable land use. However, it is a poor fit for the worldʼs land because global commons are generally understood as resources located beyond state borders. I argue that land can be seen to fit the (...) definition of a global commons, if viewed in a particular way; namely, as a biogeochemical resource system that sequesters carbon emissions. The question then arises whether land should be conceptualised as a global commons. I consider this question by reference to three contemporary problems of land justice (land grabbing, forced displacement, and unfairness in land-based climate mitigation); arguing that the global-commons framing will not be conducive to understanding or responding to these problems. I leave the question of how the global community should conceptualise land in the context of climate change open, claiming that any answer must include the voices and perspectives of those whose livelihoods and identities are closely connected to the land. This chapter concerns how the global emissions budget should be shared, critiquing the equal per capita emissions view (EPC). First, it is explained how theorists have used claims about natural resource rights to formulate the atmospheric commons argument for EPC. Then, drawing on the assessment reports of the Intergovernmental Panel on Climate Change and Elinor Ostrom’s work on common-pool resources, it is shown that these arguments invoke a misleading analysis of climate change as a global commons problem. Accurate understanding of (...) how climate change results from overuse of a global commons suggests that proponents of the commons argument for EPC overlook potential territorial claims to the climate sink. Two options for EPC theorists who wish to maintain the view in the face of this critique are identified, but both turn out to necessitate deeper engagement with the question of how rights to the world’s resources should be assigned. Although there are high hopes for these technologies, there are many unknowns including the extent to which these new transportation tools can realistically and reliably improve driver safety and affect the subjective driving experience. The trouble with the remaining essays in this collection is that their authors have not appropriated a truth given lapidary expression in Woods' essay on Kant: "Attention to the works of genius throughout the ages cultivates the sensus communis and establishes a community involved in the beautiful." Thus, while Ted Cohen is right to consider television a possible artistic medium, the objects of televisual appreciation he considers usually witness to a breakdown of a community involved in the beautiful, while the frequently nugatory objects discussed in John Brough's "Who's Afraid of Marcel Duchamp? " testify to the disintegration of the sensus communis concerned. Finally, if Paul Weiss is right in his "Creativity and Beauty" not only to designate beauty " the excellence pertinent to the creation of a work of art," but also to house it together with the quartet of truth, goodness, glory, and justice, then we can get a sense of how wisdom in both philosophy and artistic practice might he restored: through a re· discovery of the interdependence of the transcendentals. First, the tempest corresponds to his dramatic vision of the twentieth-century world, with its wars, up· heavals, and destructive forces. Second, the preposition through expresses the sober hope that for all the darkness that surrounds our century, we are actually moving toward a destination beyond the turmoil. And third, his explorations and assessments of the many facets of contemporary culture are theological voyages. In these pages readers will find many of the themes Gilkey has tackled over the years, such as God, Jesus, Creation, Providence, spirituality, the function of symbols, ethics, suffering and death, Christianity and other religions, faith and science, church and public policy. Among the most original pieces are, to my mind, Ch. 10, on the different attitudes to ethics in Christianity and Buddhism, and Ch. 14, which clarifies many aspects of suffering. The general readership made up of those interested in religion will probably enjoy these lectures, while specialists in theology or human studies are likely to find them merely impressionistic and too vague both in their cultural analyses and in their conceptual discussions. Further, there is a discrepancy between Gilkey's assessment of the human predicament and :the theological solutions he puts forward. On the one hand, the mood and the content of his assessment is neo· orthodox (inspired by his master Reinhold Niebuhr). For instance, chapters 11 and 13, on evil and sin, are typical of an acute awareness of the dark side of human conduct. As he follows this vein, Gilkey raises pertinent, profound, and difficult questions. On :the other hand, his prescriptions do not match the depth of his diagnoses. Despite his efforts at overcoming theological liberalism, he often remains confined within the limits of the Western Enlightenment. For example, like most eighteenth-century thinkers, he rejects "a level of grace beyond nature " (54). The motivation behind the study of Laura Siminoff, Christopher Burant, and Stuart Youngner (2004) was to find out more about what the general public understands and believes about when a person is dead. More specifically, the study tried to determine how (...) members of the public define death, especially their acceptance and interpretation of the medical concept of "brain death," and their attitudes toward the so-called "dead donor rule," an informal but powerful social and legal norm insisting that the taking of organs for transplantation not cause the death of the source of those organs.As the demand for organs increases and the waiting list grows, the United States has explored multiple ways to expand the pool of potential donors. One approach has been to gerrymander (coherently or not) the line between life and death to shift patients who are extremely compromised but traditionally considered to be in the living category into the dead category. In this way, the dead donor rule remains technically intact. This reasoning is explicit in the report of the Harvard Medical School Ad Hoc Committee (1968) that "introduced" "brain death" to the American culture. Since then, other efforts to redraw the line have been proposed and rejected.One alternative to gerrymandering is to consider under what conditions, if any, it is morally acceptable to violate the dead donor rule. Some would argue that this alternative is the more "honest" approach. Rather than sidestepping moral problems by calling people dead, it brings the moral problems to the surface where the necessity of sticking to the rule can be considered on its own merits. However, when the Journal of the American Medical Association printed a position paper that proposed making anencepahlic newborns an exception to the dead donor rule, along with arguments about why this was acceptable, the outcry was so great that the proposal was retracted (AMA 1995).Clearly, our society has identified organ transplantation as a priority, although two papers in this volume (those by Courtney Campbell and by Megan Crowley-Matoka and Robert Arnold) take issue with that prioritization. Voluntarism seems to have peaked. Financial incentives clash with the heavily endorsed notion of the "gift of life" and seem to many to violate the dignity of the human body. Presumed consent or eminent domain, in which the community has a greater claim to a person's organs than that person or his/her family, go against the grain of American individual freedom and the ethos of patient autonomy.Abandoning the dead donor rule generally is regarded as an even tougher sell to the American public and its legislators. This short paper provides preliminary findings into the level of moral development and ethical decision-making patterns of public relations practitioners inAustralia and New Zealand. Our findings suggest that most PR practitioners rely on their own sense of right or wrong when addressing ethical dilemmas. However, these practitioners also only exhibit very low levels of concern for Kohlberg’s postconventional stages of moral reasoning.

This article presents the findings of an empirical investigation into the role of third party interventions in the House of Lords. It examines all the judgments in that court from 1994 to 2009 and tests four hypotheses concerning the impact of the Human Rights Act 1998 upon the incidence of interventions and their influence on the decision-making of the Law Lords.

As clinical trials end, little is understood about how participants exiting from clinical trials approach decisions related to the removal or post-trial use of investigational brain implants, such as deep brain stimulation (DBS) devices. This empirical bioethics study examines how research participants experience the process of exit from research at the end of clinical trials of implanted neural devices. Using a modified grounded theory study design, we conducted semi-structured, in-depth interviews with 16 former research participants from clinical trials of DBS (...) and responsive neurostimulation (RNS). Open-ended questions elicited motivations for joining the trial, understanding of study procedures at the time of initial informed consent, the process of exiting from research, and decisions about device removal or post-trial device use. Thematic analysis identified categories related to: limited preparedness for the end of research participation, straightforwardness of decisions to explant or keep the device, reconciling with the end of research participation, reconciling post-trial expectations, and achieving a sense of closure after exit from research. A preliminary theoretical model describes contextual factors influencing the process and experience of exit from research. Experiences of clinical trial participants should guide research practices to enhance the ethical design and conduct of clinical trials in DBS and other brain devices. (shrink)

Essays devoted to the legal thought of Thomas Hobbes, arguably the greatest political philosopher to write in English.

Poor ability to regulate one's own food intake based on hunger cues may encourage children to eat beyond satiety, leading to increased risk of diet-related diseases. Self-regulation has multiple forms, yet no one has directly measured the degree to which different domains of self-regulation predict overeating in young children. The present study investigated how three domains of self-regulation (i.e., appetitive self-regulation, inhibitory control, and attentional control) predicted eating in the absence of hunger (EAH) in a community sample of 47 preschool-aged (...) children (Mage = 4.93, SD = 0.86). Appetitive self-regulation, as measured using a delay of gratification task, was significantly and negatively associated with EAH 1 year later (p< 0.5). Measures of inhibitory and attentional control did not significantly predict EAH. These results suggest that food-related self-regulation may be a better predictor of overeating behaviors than general measures of self-regulation. (shrink)

It was first suggested that the ribosome is associated with protein synthesis in the 1950s. Initially, its components were revealed as surface‐accessible proteins and as molecules of RNA apparently providing a scaffold for subunit shape. Attributing function to the proteins proved difficult, although bacterial protein L11 proved essential for binding one of the decoding protein release factors (RFs). With the discovery that RNA could be a catalyst, interest focussed on the rRNA that, in partnership with mRNA and tRNAs, could potentially (...) mediate the chemical reaction underlying protein synthesis. rRNA interactions and conformational changes were invoked as key elements that facilitated function. The decoding RFs, which are proteins, are exceptions to this rule because they usurp a tRNA function in mediating stop signal recognition. Cryoelectron microscopy and associated image reconstruction technology have now given dramatic snapshots of almost every step of protein synthesis, and X‐ray crystallography has revealed, at last, the subunits and monomeric ribosome in exquisite atomic detail. Today, DIY -- do-it-yourself -- describes more than self-taught carpentry. Social media enables DIY citizens to organize and protest in new ways and to repurpose corporate content in order to offer political counternarratives. This book examines the usefulness and limits of DIY citizenship, exploring the diverse forms of political participation and "critical making" that have emerged in recent years. The authors and artists in this collection describe DIY citizens whose activities range from activist fan blogging and video production to knitting (...) and the creation of community gardens. Contributors examine DIY activism, describing new modes of civic engagement that include Harry Potter fan activism and the activities of the Yes Men. They consider DIY making in learning, culture, hacking, and the arts, including do-it-yourself media production and collaborative documentary making. They discuss DIY and design and how citizens can unlock the black box of technological infrastructures to engage and innovate open and participatory critical making. And they explore DIY and media, describing activists' efforts to remake and reimagine media and the public sphere. This study investigates the role that moral identity, religiosity, and the institutionalization of ethics play in determining the extent of justification of norm violating behavior among business practitioners. Moral justification is where a person, rather than assuming responsibility for an outcome, attempts to legitimize ethically questionable behavior. Results of the study indicate that both the internalization and symbolization dimensions of moral identity as well as intrinsic religiosity and the explicit institutionalization of ethics within the organization are significant determinants of the (...) moral justification of unethical behaviors. Aristotle holds that rational agents can think true thoughts about their practical ends. Specifically, we can think true thoughts about whether our ends are good and able to be brought about in action. But what makes these thoughts true? What sort of thing is a practical end, such that it both is good, and also may be brought about in the future? These questions are difficult to answer. They are metaphysical questions about Aristotle’s practical philosophy: they ask what practical ends (...) are, such that they can make true certain parts of our practical thinking. What is more, key claims in Aristotle’s account of rational agency seem to make it impossible for thoughts about our practical ends to ever, in fact, be true. Given the ways in which we think about our ends, there seems to be nothing in the world to which these thoughts truthfully correspond. In this paper, I identify and solve two puzzles for Aristotle’s claim that we can think true thoughts about our practical ends. These puzzles have not been discussed in recent literature, but they have potentially wide-reaching consequences for Aristotle’s account of rational agency and motivation. My solution offers a novel account of the metaphysics of practical ends, which explains how these ends can be truth-makers for our thoughts about them. I argue that we should understand practical ends on the model of first actualities, which are also second potentialities. The idea that some actualities are also potentialities is a complicated one, but as I hope to show, it yields a straightforward and illuminating conception of practical ends. It also adds a crucial metaphysical component to Aristotle’s account of rational agency, one which shows how this account is internally consistent. (shrink)

Our research addressed an increase of unethical practices in professional settings identified in the literature, and this increase coincides with a shift in U.S. culture from principle-based ethics to one trending toward moral relativism. We discovered many programs lack comprehensiveness to deal with the complexities of culture in graduate education. The purpose of this instrumental case study was to explore and develop a conceptual framework for a comprehensive teaching model targeting graduate-level educators, administrators, and educational boards across disciplines. Data were (...) collected over 13 years from a doctoral professional ethics course at a private, faith-based university in South Texas. Using a Design Based Research process following Reeves’ (2006) guidelines, we developed a multi-disciplinary graduate theoretical teaching model for ethics: Comprehensive Professional Ethics Teaching Model (CPET model), grounded in our data analysis and findings. Recommendations include implementing and testing the efficacy of the CPET model in subsequent studies. (shrink)

In this article, we provide an ethical analysis of the first porcine cardiac xenotransplant, performed in Maryland, USA in early 2022. David Bennett was offered the experimental procedure after he was deemed ineligible for human heart transplantation and mechanical circulatory support, based on a history of non-compliance. It was reported that Mr Bennett’s previous instances of non-compliance were for medically non-life-threatening conditions years earlier, where the risks of non-compliance were not as high. We argue that, in Mr Bennett’s case, a (...) history of non-compliance in a different context, should not necessarily rule him ineligible for a potentially life-saving treatment now. Furthermore, using previous non-compliance to exclude individuals from donor organs may have the unintended effect of placing the burden of testing xenotransplantation on those who are already disadvantaged. We then argue that it is not enough to rely on patient consent to ethically justify xenotransplantation research. Taking a broad ethical perspective is crucial when mapping a clinical pathway for xenotransplantation. (shrink)

Containing valuable contributions from senior figures in the fields in which Sharp produced her most focused scholarship, the chapters in this book present a critical overview of how Sharp’s ideas relate to education, philosophy of education, and the Philosophy for Children movement as a whole. Their list is not meant to be exhaustive, but it is meant to suggest Diamond’s far-reaching significance for education and educators.

Positive emotions are highly valued and frequently sought. Beyond just being pleasant, however, positive emotions may also lead to long-term benefits in important domains, including work, physical health, and interpersonal relationships. Research thus far has focused on the broader functions of positive emotions. According to the broaden-and-build theory, positive emotions expand people’s thought–action repertoires and allow them to build psychological, intellectual, and social resources. New evidence suggests that positive emotions—particularly gratitude—may also play a role in motivating individuals to engage in (...) positive behaviors leading to self-improvement. We propose and offer supportive evidence that expressing gratitude leads people to muster effort to improve themselves via increases in connectedness, elevation, humility, and specific negative states including indebtedness. Oakeshott, Hayek and Schmitt are associated with a conservative reaction to the 'progressive' forces of the twentieth century. Each was an acute analyst of the juristic form of the modern state and the relationship of that form to the idea of liberty under a system of public, general law. Hayek had the highest regard for Schmitt's understanding of the rule of law state despite Schmitt's hostility to it, and he owed the distinction he drew in his own work between a (...) purpose-governed form of state and a law-governed form to Oakeshott. However, the three have until now rarely been considered together, something which will be ever more apparent as political theorists, lawyers and theorists of international relations turn to the foundational texts of twentieth-century thought at a time when debate about liberal democratic theory might appear to have run out of steam. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Prince Evgenii Trubetskoi, one of Russia’s great philosophers, exemplified what was best in the Russian religious-philosophical tradition. His lifelong pursuit was “integral knowledge.” This ideal affirmed that faith was integral to reason and that inner experience, and not just external sensory experience, offered truthful testimony to the nature of reality—precisely contrary to the reductive positivism and scientism of Trubetskoi’s day and ours. Following Vladimir Soloviev he developed the concept of Bogochelovechestvo —the free human realization of the divine principle in ourselves (...) and in the world —and found in it the very meaning of life. Trubetskoi strikingly combined religious philosophy with an unwavering commitment to the main principles of liberalism: human dignity, freedom of conscience, the rule of law, and human perfectibility. He worked tirelessly for a liberal, constitutional Russia. This is the first book in English devoted to Evgenii Trubetskoi’s life and thought. It includes a comprehensive introduction, six chapters on his religious-philosophical worldview, and six chapters on an area of religious studies that he inspired—the philosophy of the icon. Institutional guidelines for transgender children and adolescent minors fail to adequately address a critical juncture of care of this population: how to proceed if a minor and their parents have disagreements concerning their gender-affirming medical care. Through arguments based on ethical, paediatric, adolescent and transgender health research, we illustrate ethical dilemmas that may arise in treating transgender and gender diverse youth. We discuss three potential avenues for providing gender-affirming care over parental disagreement: legal carve-outs to parental consent, the mature minor (...) doctrine and state intervention for neglect. Our discussion approaches this parent–child disagreement in a manner that prioritises the developing autonomy of transgender youth in the decision-making process surrounding medically assisted gender affirmation. We base our arguments in the literature surrounding the risks and benefits of gender-affirming therapy in transgender children and the existing legal basis for recognising minors’ decision-making authority in certain medical situations. It is certainly true that she inspired a generation of Anglo-American philosophers who sought to critique the moral philosophy of their day. However, these philosophers drew almost exclusively from her early philosophical thought, most notably The Sovereignty of Good. When it came to Murdoch’s second book, Metaphysics as a Guide to Morals (MGM), moral philosophers and scholars alike found it hard to place within contemporary (...) moral philosophy.Our aim in this paper is to offer a reading of MGM that is resolute in its commitment to do justice to the book’s resistance against domestication within standard moral philosophy, while taking Murdoch at her word when she writes that her “whole argument can be read as moral philosophy” (MGM, 740). This commitment allows us to read MGM as an integrated unity. More importantly, it allows us to reassess Murdoch’s place in twentieth-century philosophy and to propose MGM as one of the works seeking to transform it. Our hope is that our reading will interest any philosopher who feels that something essential is missing in current typical practices in the discipline. (shrink)

Rather than looking at protest in the ideal case, this book looks at how protest is actually practiced and argues that suitably constrained violent political protest is sometimes justified.
